Facebook and WhatsApp have challenged the CCI’s March 24 order which has ordered an inquiry into their new privacy policy.
The Delhi High Court can pronounce the verdict on Thursday on the petition of social media platform Facebook and WhatsApp challenging the CCI order of Competition Commission of India. The CCI, in its order, ordered an inquiry into the new privacy policy of WhatsApp. Justin Naveen Chawla reserved the verdict on two separate petitions on WhatsApp and Facebook on 13 April.
Keeping the order safe, the court said that, the CCI order does not reflect the investigation of misuse of any key post, but is concerned about the privacy of the users. The court made this comment on CCI’s stance in which it said that it is not investigating the violation of privacy of individuals which the Supreme Court is looking into.
CCI has stated its position before the court that, due to the new privacy policy of WhatsApp, excessive data collection can occur and violate the privacy of users for their advertisements. Facebook and WhatsApp have challenged CCI’s March 24 order ordering them to investigate their new privacy policy.
The CCI also told the court that, after investigation, it can be known whether the data collection done by WhatsApp and sharing it with Facebook is a misuse of such a big post. CCI also said that, the data collected is the user’s location, the device used, the Internet service provider and who they are talking to. Using this, a user’s profile can be created and targeted advertising can be done through it.
On the other hand, both these social media platforms told the court that, when the Supreme Court and the High Court are looking at the privacy policy, then the CCI should not come into it nor interfere. Both social media platforms also told the court that users’ private conversations are protected through end to end encryption and WhatsApp does not monitor people’s chats.
