The ongoing ruckus between the central government and WhatsApp is not taking the name of lessening. The Central Government has submitted an affidavit to the Delhi High Court regarding the matter of WhatsApp. In this, the government has accused WhatsApp of misusing its capability. The Center told the court that WhatsApp is using “anti user practice” i.e. anti-user practices to get its updated privacy policy approved.
The government told the Delhi High Court that WhatsApp is showing its digital power without thinking and repeatedly sending notifications to users to force them to accept the new policy. Its planning is very clear that it wants to bring its users under its updated policy even before the personal data protection bill becomes law. The Center also said that the repeated compulsion of its users by WhatsApp for the policy is “against the prima facie view of the order dated 24/03/2021 of the Competition Commission of India”.
Along with this, the government has requested the Delhi High Court to issue an order to stop any notification being sent to the users to follow the updated policy of WhatsApp and also to keep a record that as of today. Till how many notifications have been sent to the users. Along with this, WhatsApp has also been asked to give a record of what has been the conversion rate on the notification sent to the privacy policy, that is, how many people have accepted it through the notification.
The government’s response came after several petitions were filed against the updated policy of WhatsApp. One of these petitions was filed by Dr. Seema Singh, Meghan and Vikram Singh. It was demanded that either WhatsApp withdraw its policy or give users the option to opt out of it. In response, WhatsApp said that it is not forcing any user to follow the updated policy, its privacy policy is not mandatory.
In a fresh affidavit, WhatsApp said that the 2021 update is an agreement between private parties that users are free to accept or reject. WhatsApp has urged the Delhi High Court to dismiss the petition challenging its updated privacy policy. Further hearing of the matter has been adjourned till July 22.
