- HC seeks suggestions from court friend and respondent side
Nagpur. Taking suo motu cognizance of the reports about several accidents involving nylon manja, the High Court accepted it as a public interest litigation. During the hearing on the petition on Wednesday, it was disclosed before the court that there was no provision for punishment regarding nylon manja. After which Justice Sunil Shukre and Justice Anil Pansare ordered the court friend and the respondent to suggest new provisions and options for the purpose of setting new guidelines regarding punishment and recommending it to the state government. As a court friend Deven Chauhan, on behalf of Govt. dp Thackeray, on behalf of Municipal Corporation, Mr. Jaimini Cast, on behalf of the Municipal Council, Mr. Mahesh Dhatrak argued.
Provision in Maharashtra Police Act also
During the hearing on Wednesday, the court said that despite the restrictions imposed in accordance with the National Green Tribunal and the Environment Act, there is no effective provision for imposing appropriate fine and fixing punishment if found violating it. Due to which it has become necessary to issue appropriate guidelines in this regard. Advocate adv. on behalf of the Interwinner. Firdous Mirza said that action can be taken according to section 113 of the Maharashtra Police Act. Even in Section 117, a provision of punishment has been given for flying kites illegally. But in the present environment, the intention was expressed to be quite complicated to implement such provisions.
Stricter monitoring than last year
During the last hearing, a notification from the Environment and Meteorological Department was placed before the court. To which the court said that the orders given by the High Court on December 15 were to follow the guidelines given by the National Green Authority across the state. The measures being taken by the court friend as well as the respondent side regarding nylon manja this year are being seen. Certainly stricter monitoring is being done as compared to last year. The fate of which is that the use of nylon manja is rarely visible during the kite flying season. Everyone believes that appropriate steps are being taken by the authorities.
