Nine-year-old Olivia Pratt-Korbel screamed “Mum, I’m scared” seconds earlier than she was shot useless in her own residence, a courtroom has been instructed.
Olivia was killed on 22 August final yr as a gunman chased convicted burglar Joseph Nee into her house. Her mom, Cheryl Korbel, 46, was injured within the capturing.
Thomas Cashman, 34, is on trial for her homicide, which he denies.

‘Mum I’m scared’
David McLachlan KC, opening the case for the prosecution, instructed the jury: “Cheryl Korbel said ‘I’ve been shot’.
“She turned spherical and noticed her daughter, Olivia, on the backside of the steps – she referred to her as ‘the child’, as we do on this space.
“She said ‘I remember when I turned round and realised the baby was right behind me … because she’d come … obviously come down the stairs ’cause she’d heard.
” … she went all floppy and her eyes went to the again of her head.
“And I realised that she must’ve been hit – because I didn’t know until then – and I lifted her top up and the bullet had got her right in the middle of the chest.”
Jurors heard Olivia’s older brother, Ryan Korbel, described the schoolgirl operating downstairs screaming: “Mum I’m scared.”
Her sister, Chloe Korbel, heard their mom screaming that “Livia had been hit”.
Ms Korbel was heard saying “stay with me, baby”.

Mr McLachlan stated Cashman, 34, had two loaded firearms in his possession on the evening of the capturing and was “lying in wait” for Mr Nee, who was “without doubt the intended target”.
He stated Mr Nee was watching a soccer match on the home of Timothy Naylor in Dovecot, Liverpool, and when he left the home at round 10pm a gunman, who the prosecution alleges was Cashman, ran behind him and fired three pictures from a self-loading pistol, certainly one of which hit Mr Nee within the midriff.
Mr Nee stumbled and Cashman stood over him and tried to fireside once more however, presumably as a result of the pistol malfunctioned, he was unable to finish his “task” and kill Mr Nee, Mr McLachlan stated.
The deadly shot
The prosecutor stated Ms Korbel opened her entrance door after listening to a noise outdoors and as she did so Mr Nee “made a dash” in the direction of her home, with Cashman in pursuit.
Cashman fired at Mr Nee from a second weapon, a revolver, and hit the entrance door of the household house, the courtroom heard.
Mr McLachlan stated: “That fourth likely shot passed through the door, it then passed through Cheryl Korbel’s right hand as she was no doubt trying to shut the door. The bullet then went into the chest of Cheryl Korbel’s daughter Olivia Pratt-Korbel.”
Mr Nee managed to get inside the home and Cashman allegedly fired once more into the doorframe, after getting his arm across the door. He then ran away.
Mr Nee had stumbled out of the home, collapsed in the course of the street and used his cell phone earlier than being picked up by 5 males in a black automotive earlier than police arrived.
Olivia was pronounced useless at Alder Hey Children’s Hospital later that evening.
Shooting went ‘horribly improper’
Mr McLachlan stated: “The shooting had gone horribly wrong.
“This is what this case is all about. This is severe enterprise, as you’ll admire.
“The prosecution say it’s about the ruthless pursuit by Thomas Cashman to shoot Joseph Nee at all costs without any consideration for anyone else in the community.
“Thomas Cashman’s actions resulted in Joseph Nee being injured, Cheryl Korbel being injured and, most tragically of all on this case, Olivia Pratt-Korbel being killed.”
Cashman, of Grenadier Drive, Liverpool, denies the homicide of Olivia, the tried homicide of Mr Nee, wounding with intent to do grievous bodily hurt to Ms Korbel and two counts of possession of a firearm with intent to hazard life.
The trial is predicted to final 4 weeks.
