Germany’s leading data protection regulator plans to take action against Facebook regarding data collection of WhatsApp users
Instant messaging platform WhatsApp has changed its policy a few months ago, which all users will have to accept or else their account will be banned. Regarding this, Germany’s leading data protection regulator for Facebook has said that it was taking action against this social network company to stop the personal data collection of WhatsApp users.
The regulator said that it had started emergency proceedings against Facebook after WhatsApp introduced new privacy terms earlier this year. In fact, Facebook-owned WhatsApp earlier this year had informed its users to agree on new data terms or to stop using the service. Since then, it is being continuously opposed.
Johannes Caspar, Hamburg’s data security officer, said, “We have reason to believe that the data sharing policy between WhatsApp Facebook is being implemented due to lack of voluntary and informed consent.”
Caspar leads Facebook’s domestic inspection under Germany’s federal system, and said he was launching a formal administrative procedure to help track this illegal data exchange and reach a verdict before May 15.
WhatsApp spokesperson gave this statement
A WhatsApp spokesperson said that our recent update includes new options, people need to message a business on WhatsApp, and provide more transparency into how we collect and use data. Make it clear that the user’s acceptance of WhatsApp’s new term of service is not increasing in any way our ability to share data with Facebook and this update of messages made by friends or family with them. Does not affect privacy.
This German regulator has opened the front regarding the privacy policy of Facebook. At the same time, the National Antitrust Regulator is already fighting a legal battle with Facebook over data practices. It has been said that Facebook has misused its dominance in the social network market.
A three-month ban is planned
Since 2018, online privacy has been a subject in the European Union’s rulebook and has been named General Data Protection Regulation (GDPR). Ireland works under Facebook’s domestic inspection under GDPR because the company’s European headquarters are there.
Casper said he was demanding a three-month ban on the collection of WhatsApp users’ data citing “exceptional circumstances” in the GDPR. This can be extended by the European Data Protection Board, a group of regulators from 27 member states.
