The Delhi High Court on Tuesday directed Twitter to inform when it will appoint Resident Grievance Officer (RGO) as per the new IT rules. The microblogging platform has submitted to the court that it is in the process of doing so. Justice Rekha Palli objected that the court was not informed that the earlier appointment of the RGO was only on interim basis and he had resigned.
The High Court noted that only one interim RGO was appointed by Twitter and on May 31, the court was given wrong information as it was not told that the appointment was made on an interim basis.
The judge said that if he had left on June 21, then at least Twitter could have appointed another officer in these 15 days, because you knew that the matter was going to be heard on July 6. We are concerned on the issue of compliance. How long does your process take? If Twitter thinks it can take as long as it wants in my country, I don’t allow it.
Twitter has sought time from the court
Senior advocate Sajan Poovayya, appearing for Twitter, said that though Twitter is in the process of making appointments, it is true that as on date there is no Chief Compliance Officer, RGO and Nodal Contact Person. He further said that therefore, as the court said, Twitter is not in compliance with the rules as of now. But he is in the process of appointing an officer. When an intermediate is not in compliance with the rules, it loses the safe harbor protection. It is true that Twitter should follow the rules and it will. Please give us proper time.

Additional Solicitor General Chetan Sharma, representing the Center in the court, said the rules were notified on February 25 and intermediaries were given three months to comply with the rules, which ended on May 25. He said in the court that we are on 6th July. This is a full 42 days of non-compliance. They are fully welcome to do business in India. But this attitude is of no respect for the digital sovereignty of this country.
