Nagpur. Due to non-compliance of the orders given by the High Court, Gumpha Thul filed a contempt petition in the High Court. After hearing the petition, Justice AS Chandurkar and Justice Pushpa Ganediwala gave the government the last opportunity to decide on the petitioner’s application in two weeks. Along with this, if the decision is not taken within these 2 weeks, then the Education Officer (Secondary) and other respondents were also ordered to remain present in the court on February 11. The High Court ordered the public prosecutor to inform the concerned respondents about this order. On behalf of the petitioner PD Meghe and Assistant Public Prosecutor HN Jaipurkar argued on behalf of the government.
Broken service for 3 and a half years
According to the petitioner, the petitioner working in class IV had applied to the Education Officer (Secondary) on 7 September 2020. In this, a request was made to ignore the broken service from 1 January 2013 to 19 July 2017. But the decision was not taken on this. Due to this, a civil petition was filed in the High Court. During the hearing of the petition, the government side was of the view that the service has been fractured for more than a year. Due to this, the High Court had given orders to the education officer to send this application to the state government. The court had made it clear in the order that whatever decision is taken by the state government should be done within 8 weeks.
Report was sought from the Deputy Director
During the hearing, the Assistant Public Prosecutor, appearing for the government, told the court that in May 2021 itself, the petitioner’s application has been sent to the state government by the Education Officer. On this the court was of the view that even though the application has been sent to the state government, there is no detail of the present status of the application in the affidavit filed. On the contrary, on October 21, 2021, the order given to the Deputy Director of Education to check the information recorded in the service book of the petitioner has been disclosed in the affidavit. Along with this, a report was also sought from the Deputy Director. Therefore, according to the orders of the High Court, till now any decision has been taken on the application or not, it is not being disclosed. After a long hearing, the court issued the said order.
