Nagpur, The teacher who raped the girl student was sentenced to 10 years rigorous imprisonment by the Additional Sessions Judge under the POCSO Act. Apart from this, for tampering with evidence, he had to undergo a separate sentence of 2 years. Teacher Mahindra Ambilduke filed an application in the High Court requesting the cancellation of this sentence and grant of bail.
After a long hearing on the petition, Judge Surendra Tawde flatly refused to grant relief, giving the reason why it was not appropriate to release the rapist teacher on bail. continuous harassment for one year
Opposing the application on behalf of the government, it was said that the offense committed by the petitioner is very serious. The victim was tortured for a year. Due to her young age, the victim could not tell the exploits of this rapist to the family members. The teacher took him to many places. The rape of her has been found to be true in the medical examination. There is strong evidence against the teacher. After hearing all the parties, the court said in the order that the teacher had invited the victim on her birthday. Taking her to different places raped the victim. The victim has recorded the entire incident through her statement. Several threats were also made to the victim for not exposing the harassment.
Strong evidence against the rapist
The court said in the order that the victim has highlighted finer points in her statement. The teacher took him several times to hotels and lodges. He kept on threatening and raping against his will. All these evidences of the prosecution are strong evidence of the case. The information recorded in the FIR is not just a story. The victim was tortured by showing various types of lewd films. The victim was a child during the incident, while the petitioner was a teacher as well as had a wife and children. This reality cannot be denied. In view of this, it would not be appropriate to release him from jail on bail.
