Nagpur, A petition in the High Court on behalf of Anjuman Hami-e-Islam Trust, citing the weak financial condition of the institution due to non-recovery of rent from the builder in the building situated on Residency Road of Sadar, despite having government offices like banks etc. filed. After hearing the petition on Friday, Justice Sunil Shukre and Justice Anil Pansare issued notices to 57 shopkeepers, including Co-Charity Commissioner, Gani Trust, and ordered them to file a reply within two weeks.
On behalf of the petitioner Mohan Sudame argued. During the hearing, the court was told that the Anjuman Trust had land on Sadar Residency Road. On this land, 5,000 square feet of land was allotted on a 99-year lease on the condition of making a shop, letting it out on rent and using the rental income for charitable and educational matters like helping hospitals etc.
Only 30 percent of the rent
The petitioner told the court that during the year 1980, the petitioner did not have the funds to carry out the construction work on such a huge land. Therefore, for the interests of the society, at the same time the land was given to Gani Trust on a lease of 99 years. While giving the land, the condition was made to use the funds received from it for charitable and educational works only and 30 percent of the fund received from rent was given to Anjuman Trust. super. Sudame said that for a long time there was no elected committee in the Anjuman Trust, due to which nothing was done in this regard even after the trust stopped getting rent from the year 2009. Many types of educational institutions are also run by Anjuman, in which 470 employees are employed. Due to the impact on the income of the trust, there is a financial burden.
2 crores per annum about Rs. Rent
super. Sudame said that as per the lease agreement with Gani Trust, considering the 30 per cent share in the rent, about Rs 2 crore per annum was to be received by the petitioner as rent. There are shops of many big companies in the whole building. Even big builders and banks are in this building. But rent is not coming for 13 years. It was decided to collect rent from Gani Trust, but the condition worsened due to lack of competent members in Ghani Trust itself.
Due to this, in the year 2020, an application was filed with the Co-Charity Commissioner for the appointment of competent members on the Gani Trust. No decision was taken on this application also. As a result the problem could not be solved. The petitioner requested to order all the 57 shopkeepers to deposit the rent amount in the court. After the hearing, the court issued the said order.
