Sagar was accused of being recognized while traveling with the complainant girl who was studying with him. Then there was friendship and love affair. After this, Sagar made physical relations with the complainant at various places on the pretext of marriage. When the complainant pressed for marriage, Sagar refused. After this, the girl filed a case of rape against Sagar under the Atrocity Act, as well as under the pretext of marriage.

During the hearing, the prosecution examined a total of 5 witnesses and presented the documents of the lodge where the accused had taken the victim to the court. On the other hand, Advocate RK Tiwari, appearing for the defense, argued that while the accused and the girl had a love affair, they had promised marriage and both had an emotionally physical relationship. But the intention of the accused was not to cheat the girl on the pretext of marriage.
Sagar’s family members had made preparations for his and the girl’s marriage, but Sagar’s brother started opposing the marriage of Sagar and the girl against the family members. Due to heavy pressure, Sagar had to refuse to marry the girl. In such a situation, it would not be fair to say that Sagar gave a false promise of marriage. Accepting the argument, the court acquitted the accused.
