Nagpur. After the incident on 26 January 2001 at the Dr. Hedgewar memorial, the District Sessions Court had given orders to the Kotwali police to hand over the confiscated tricolor to the District Magistrate. Petitioner Mohnish Jabalpure filed a contempt of court petition in the District Sessions Court, objecting to its non-compliance despite the order being issued in the year 2013. After hearing this, the court issued notice to the Kotwali police and ordered them to file a reply.
12 year case
It is noteworthy that some people tried to hoist the flag by visiting the Dr. Hedgewar memorial at Reshambagh on 26 January 2001, accusing the RSS of not hoisting the tricolor. A case was registered with the police regarding the incident that happened during this period. Even the police took action against 3 people. The bamboo and tricolor were confiscated by the police during the action. The case was heard in the District Sessions Court for 12 years, after which on 6 August 2013, the District Sessions Court had also ordered to respectfully hand over the national flag seized by the police to the District Magistrate. Despite the orders of the court, it was not followed. With this now a contempt petition was filed.
Information exposed in RTI
Petitioner Mohnish Jabalpure had given a memorandum to the District Magistrate for getting the flag regarding the tricolor. Even on 2 April 2021, information was also sought under the Right to Information. In this, it was revealed by the District Magistrate’s office that the national flag is still confiscated with the police. As soon as the reality came to light, a petition was filed in the court.
