Aurangabad : Supreme Court Chief Justice V Ramanna, Justice AS Bopanna and Justice Hima on Thursday on a special leave petition filed in the Supreme Court by BJP leader and former corporator Samir Rajurkar regarding the division creation of the Municipal Corporation. The detailed hearing was held before the division bench of Kohli. Due to the creation of a new division during the hearing, it has become practicable for the petition to be disposed of, as the purpose of the petition has been served. This argument was given by the State Election Commission in the Supreme Court.
Petitioner Sameer Rajurkar has agreed to dispose of the petition due to the creation of a new division. However, confidential information about the composition of the former division has been largely passed on to the political parties. The illegal division was created on its basis. This was acknowledged by the State Election Commission itself in the affidavit presented before the Bench. Aurangabad Municipal Corporation Commissioner Astik Kumar Pandey had taken the matter seriously and ordered action against the concerned. Due to which there will be no further breach of privacy. This instruction should be given to the State Election Commission. Accordingly, while framing the division, an opportunity of a detailed hearing should be given while executing the legal process. Only then finalize the ward structure and reservation. Petitioner Sameer Rajurkar requested to give this direction to the State Election Commission.

With the disposal of the petition, the way for the Aurangabad municipal elections has been cleared. But, the State Election Commission will have to strictly follow the decision of the Supreme Court while making the ward composition.
