The Supreme Court on Wednesday quashed the order of the Punjab and Haryana High Court staying the Haryana government’s law on providing 75 per cent reservation in private sector jobs for local residents in Haryana. Also, the Supreme Court has told the state government that it cannot take any coercive action against the employers.
Let us inform that according to an order of the state government, the rule of 75 percent reservation for the youth of the state in private jobs in Haryana has come into force from January 15. On February 3, the High Court had granted an interim stay on the Haryana government’s law on petitions filed by various industry associations of Faridabad and other organizations in the state, including Gurugram. In this Act, there is a provision to provide 75 percent reservation to the people of the state in the private sector in Haryana.
It was notified in November last year and came into effect from January 15, 2022. This is for those jobs in which the maximum monthly salary is Rs 30,000. This Act applies to employers of private sector companies, societies, trusts, limited liability partnership firms, partnership firms and any person who is engaged in manufacturing, carrying on business or in any other service, on salary, wages, or other remuneration of 10 or more Hires more people.
A bill related to this was passed in the state assembly in November last year. After this, Chief Minister Manohar Lal Khattar had said that this act will be implemented from January 15, 2022. The youth of the state will get the benefit of 75 percent reservation in private jobs with salary up to Rs 30,000. Earlier this limit was up to Rs 50,000, however later last year another notification was issued, saying that the upper limit has been reduced to 30,000.
Each employee will be required to hire 75 percent of the local candidates for posts where the gross monthly salary is Rs 30,000 or less, as notified by the government. A local candidate may be a resident of any district of Haryana but the Company or the employer shall have the discretion to limit the employment of a resident of any district to 10 per cent of the total candidature.
The officers of the level of Deputy Director of Industries and Commerce Department will monitor. However, this rule will not apply to brick-kilns. This law will be applicable in the state for 10 years. Haryana government has provided some concessions in hiring in private companies. Now the residency condition has been reduced from 15 to five years for obtaining a genuine resident certificate in the state.
