Twitter has given a clarification regarding the temporary locking of the account of Union Information Technology Minister Ravi Shankar Prasad. According to news agency ANI, a Twitter spokesperson said that only due to the DMCA (Digital Millennium Copyright Act) notice, the access to the minister’s account was temporarily locked and the related tweet has been stopped. Ravi Shankar Prasad had earlier told that his account was restored after not getting access for about an hour.
A Twitter spokesperson said, “In accordance with our copyright policy, we respond based on complaints sent by the copyright owner or their official representatives.” Ravi Shankar Prasad shared the notice received from Twitter, which read, “Your account has been locked because Twitter has received a complaint of Digital Millennium Copyright Act on content posted from your account. Under the DMCA a copyright claimant can notify Twitter that the user has infringed on their copyrighted works. Upon receipt of this notice, Twitter will remove the relevant content.”
The Union Minister had reacted sharply to this action of Twitter. Sharing a screenshot of the notice, he wrote, “This action of Twitter is in violation of Rule 4(8) of the Information Technology Rules 2021 (Intermediary Guidelines and Digital Media Ethics Code), under which they did not give any notice before removing the access to the account. “

Prasad further wrote, “It is clear that because of my statements, Twitter has taken such arbitrary action. The sharing of my interviews on TV channels and its huge impact has clearly upset Twitter.” He wrote that it is now clear why Twitter is refusing to follow the intermediary guidelines, because if Twitter does so, it will not be able to arbitrarily block access to the account of anyone who does not fit its agenda.

In the event of any allegation of posting of alleged illegal content resulting in loss of intermediary status in India, Twitter will be deemed to be its publisher and may be punished under the law.
