Action has been demanded against WhatsApp for not following Indian IT rules. For this, a petition has been filed in the Kerala High Court asking for a ban on it.

The demand for banning WhatsApp intensified on charges of violating Indian laws and not cooperating with enforcement agencies. A Public Interest Litigation (PIL) has been filed in this regard in the Kerala High Court. This petition has been filed with the allegation of Omanakuttan of Idukki district.
The PIL alleged that WhatsApp was not cooperating with the law-enforcement agencies of the country. Also raising questions in the PIL, it was said that the instant messaging platform has a separate privacy policy for the European region which is in line with the laws prevailing there. “If the APP can change its functionality in accordance with the laws of the European region, why hesitate to comply with the laws of our country?”
Anti-social activities can be encouraged
The petitioner denied the appeal filed by WhatsApp in the Delhi High Court and its claim. According to him the claim of the app is against the right to privacy. It is to be known that WhatsApp had clarified that it cannot trace the origin of messages due to end-to-end encryption policy. Hence he is not liable for the new IT regulations. It is also used by anti-national and anti-social elements for their activities. Therefore it should be banned.
Earlier there was a setback from Delhi High Court
The Delhi High Court had dismissed a fresh petition by Facebook and WhatsApp seeking a stay on the notices issued by the Competition Commission of India (CCI). In the notice, some documents were asked to be submitted in connection with the investigation being done on the new privacy policy of WhatsApp. A vacation bench of Justices Anoop Jairam Bhambhani and Jasmeet Singh said a similar application to stay further steps in the investigation had already been filed by WhatsApp and Facebook before the regular bench hearing the primary matter.
