Delhi High Court has sent notice to the Center on the petition of Uday Bedi.
The Delhi High Court on Thursday sought the Centre’s response on a plea challenging the new IT rules, which allegedly violated the fundamental rights of free speech and privacy of users of social media intermediaries such as WhatsApp, Instagram and Twitter. A bench of Justices Chief Justice DN Patel and Justice Jyoti Singh issued notice to the Center on a plea by advocate Uday Bedi, who contended that the new IT rules are unconstitutional and contrary to the basic principles of democracy.
Giving time to the Center to file its counter affidavit, the court listed the petition for further hearing on September 13. In her petition, Bedi has argued that social media intermediaries cannot be empowered to take a decision on the basis of a complaint after which the information is deleted.
The petition states that the new IT rules themselves do not define how social media intermediaries will voluntarily act against a complaint without looking at all the conversations on the SMI platform and it is not possible to trace the first originator of a message that is being sent to the platform. The rules also state that even if the person is not under investigation for violation of the rules, the intermediary must retain his data without any justification, which is a gross violation of the right to privacy of the users.
Let us tell you that earlier, during the petition file, it was said on behalf of the advocate that in the new IT rule, social media mediators have been given wide powers, which is unfair and not legal. Uday Bedi had challenged the provisions of rules 3 and 4 in the petition. He said that under this, social media gives wide powers to middlemen to voluntarily remove access to information on the basis of complaints received from private persons, which is not fair.
