In the application given to the CJM, Investigating Officer Diwakar, referring to the above case, said that in the case of offense number 219/21, under sections 147, 148, 149, 279, 338, 304A, 302 and 120B, Ashish Mishra and others A case was registered against him. Under this, a total of 13 people including accused Ashish Mishra were arrested under the above sections.
According to the SPO, the investigating officer has said in the application sent to the CJM that it has been proved from the analysis and collected evidence so far that the criminal act by the accused was not done by negligence but with the intention of killing life under a deliberately planned conspiracy. Due to which five people died and many were seriously injured. The Investigating Officer has dropped sections 279, 338 and 304A of IPC and added sections 307, 326, 34 and 3/25/30 (Arms Act) of IPC in this case.
The SIT has upheld other sections 147, 148, 149, 302 and 120B of the IPC in this case. “The Chief Investigating Officer urged the court to rectify the warrants of the 13 accused, who are presently in judicial custody,” Yadav said. Four farmers, a journalist, two BJP workers and a driver were killed in violence that broke out in Tikunia area of Lakhimpur Kheri district on October 3 during a protest by farmers for the visit of Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya. .
Two FIRs have been registered in this regard at Tikunia police station. The first FIR was lodged by a farmer Jagjit Singh in connection with the death of four farmers and a journalist, in which he had accused Ashish, son of the Union Minister of State for Home, and 15 to 20 others.
The second FIR was lodged by Bharatiya Janata Party (BJP) worker Sumit Jaiswal in connection with the death of two BJP workers and a driver in which he had accused unidentified miscreants.
