Bangalore: Girl students, who have filed a petition in favor of wearing hijab, requested the Karnataka High Court on Monday to allow them to wear hijab in the color of school uniform. The girls, who have challenged the government’s order prohibiting wearing of any clothes affecting peace, harmony and law and order, made this submission before a full bench of Chief Justice Ritu Raj Awasthi, Justice J M Qazi and Justice Krishna M Dixit. Advocate Devdutt Kamat, appearing for these girls of Government Pre-University College, Udupi, told the bench, “I am challenging not only the government order, but also the positive mandate of allowing wearing of uniform colored hijab.” I’m doing it too.”
Kamat claimed that Muslim girl students are allowed to wear school uniform hijab in Kendriya Vidyalayas and the same can be done here as well. He said that wearing the hijab is a compulsory religious practice and prohibiting its use is a violation of the rights enshrined in Article 25 of the Constitution.
He also said that the government has authorized the Education Development Committee (CDC) with the presence of an MLA to fix the uniforms. He also said that the pre-university second year girl students have been wearing hijab since the time they took enrollment two years back.
Kamat said that “the government says wearing hijab can become a problem because other girl students also want to display their religious identity.” The court has decided to continue the hearing of the case on Tuesday.
