Nagpur. Regarding the general elections to be held in the near future in the municipal corporations of the state, on the one hand, the process was completed by the State Election Commission regarding the creation of a 3-member division. At the same time, by amending the Maharashtra Municipal Corporation Act on behalf of the state government, a bill was passed to keep the rights of division creation with the government. According to sources, due to this bill of the state government, now the possibility of conflict between the state election commission and the state government cannot be ruled out.
Recently, the state government had filed an application in the Supreme Court seeking to ensure OBC reservation in local bodies, but it was turned down by Suco. Due to which, on the lines of Zilla Parishad, the State Election Commission is expected to hold elections without OBC reservation. Whereas the state government is not in favor of holding elections without OBC reservation. Due to all the issues being contradictory to each other, there may be a tussle between the Commission and the government in the near future.
confusion over approval from the governor
According to experts, the bill was passed by the state government in the assembly. Now this bill will be placed on the table of the Legislative Council. Where after the discussion, as soon as the approval is received, it will be sent for the approval of the Governor. It is believed that even if the state government passes it in the house, there is a state of confusion regarding the approval of the governor.
At present, there is a conflict between the state government and the governor over many issues. Even the list of 12 MLAs is pending with the Governor for a long time. Due to which there have been constant accusations and counter-accusations against each other. Similarly, now again a bill will go to the governor’s court. Until the approval of the Governor is not given, it is not even possible to proceed with the process of election.
then elections will be postponed for a long time
According to legal experts, the State Election Commission has all the right to complete the election process. The State Election Commission is an independent entity. According to the constitutional methodology, the powers of the State Election Commission cannot be encroached upon. It is unfair to do this through a bill by amending in this way. If this is challenged judicially, then the whole matter will get stuck in a judicial battle. After which the election is likely to be postponed for a long time. A petition was filed in the High Court regarding OBC reservation in the Zilla Parishad. After which the Zilla Parishad elections were stuck for a long time like this.
Will clear in 2-3 days
There may have been turmoil regarding the division reservation, but some senior BJP functionaries and senior councilors believe that the situation regarding the municipal elections will be clear in 1-2 days. After hearing the objections and suggestions received regarding the creation of a new 3-member division, the entire report was submitted by the Municipal Corporation to the State Election Commission on March 2. After the report is received, usually in 8 days, the final division composition is announced by the State Election Commission. Since till now the process of final approval of the state government’s bill has not been completed. Therefore, if the final division composition is announced by the State Election Commission, then the election process will proceed.
