The Delhi High Court has reprimanded the Central Government for failing to spend the Fund for Rare Diseases of Children. The High Court on Tuesday said that the Center has not given any reasonable explanation for its failure to spend the Rs 193 crore fund. The court said that despite having funds, it cannot allow children to die like this.

The High Court pulled up the authorities in this case, saying that this serious matter was made a joke. It is astonishing that the funds were not spent on children suffering from rare diseases even though they existed. A bench of Justice Rekha Palli of the High Court said that the affidavit filed by the Central Government has not given sufficient reason as to why it was not spent despite having funds for rare diseases of children. The High Court said that the government’s affidavit also does not give any valid reason as to why the names of the children on whose behalf the petition has been filed have not been included on the digital crowdfunding platform till date. This platform was started for medicine and treatment of rare diseases of children.

The court rejected the argument of the government’s fund lapse
The High Court has asked the government to see whether the treatment of the children who filed the petition is possible with this fund. If this is possible, then he should adjust this money with the money received from crowd funding. The court ordered Additional Solicitor Chetan Sharma to take directions on the issue and fixed the next hearing of the matter on December 14. The High Court did not accept the contention of the Central Government, in which it was said that the unspent fund has lapsed. The court said that after all what kind of answer is this. During the hearing, the matter of transfer of funds collected from the general public in the name of treatment of rare diseases of children from Kerala High Court also arose. The High Court said that it has filed a petition in the Kerala High Court in this matter.
