The notice issued by the RBI for disclosing information such as the list of defaulters and its inspection report under the RTI Act by PAB was challenged in the Supreme Court.

The Supreme Court has refused an interim stay on the RBI notice asking Punjab National Bank to disclose information such as the list of defaulters and its inspection reports under the RTI Act. Not only this, the court has sought answers from the Centre, Federal Bank and Central Public Information Officer. The apex court has set aside the petition filed by HDFC Bank like Punjab National Bank (PNB).
A bench of Justices S Abdul Nazeer and Krishna Murari said, “Tag the writ petition (Civil) of the Notice, 2019 with (HDFC Petition) and fix it for hearing on July 19.
It is to be known that under Section 11(1) of the Right to Information (RTI) Act, RBI had asked banks to share information related to their inspection reports and risk assessments in the notices. Banks were unhappy with this. To challenge this notice of RBI, Punjab National Bank had filed a petition in the Supreme Court.
PNB had appealed for an interim stay on the RBI’s direction to provide information like list of defaulters and their inspection reports. Which was rejected by the court. Let us tell you that the RTI Act empowers the Central Public Information Officer (CPIO) of RBI to seek information from banks for information seekers.
Several FIs and banks, including Canara Bank, Bank of Baroda, UCO Bank and Kotak Mahindra Bank, had filed applications in the apex court seeking recall of the 2015 judgment in the Jayantilal N Mistry case, stating that the judgment had far-reaching implications. There will be results and moreover they were influenced to a great extent by it.
