Amul Dairy and its marketing company Gujarat Co-operative Milk Marketing Federation (GCMMF) had filed a complaint against Amul Canada in the Federal Court of Canada.
32 thousand 733 Canadian dollars will be available as damages.
Amul has won for the first time outside India in terms of trademark. Canada has recognized ‘Amul The Taste of India’. The Intellectual Property Appellate Board of Canada has recognized the trademark of Amul. This was the first time that Amul had filed a complaint against a company on foreign soil in such a case. The Canadian Appellate has also ordered Amul to pay 32 thousand 733 Canadian dollars in this case.
Amul Dairy and its marketing company Gujarat Co-operative Milk Marketing Federation (GCMMF) filed a complaint in the Federal Court of Canada against Amul canada and four others – Mohit Rana, Akash Ghosh, Chandu Das and Patel. This complaint was related to trademark. In January 2020, Amul came to know that a fake company was being run in Canada under its name and logo. Only the top four people work in this company.
Canadian Federal Court’s decision
Amul complained about this earlier but it was not given a proper reply from the front. Later, the matter reached the appellate and the counsel appearing for Amul said that the company has never issued a license. The Canadian Federal Court found that what is being said by Amul is factual and true. In such a situation, the appellate ruled in favor of Amul and also announced compensation for the loss.
Export to Canada since 2 years
Gujarat Co-operative Milk Marketing Federation has been exporting Amul milk since last 22 years. It is also exporting to Canada for the last two years. This includes products like Amul Cool, dairy snacks and ice cream. Amul is the world’s eighth largest milk processor with a turnover of 10.3 million metric tonnes of milk every year. Its annual turnover is 40 thousand crores. It amounts to $9 billion in Canadian dollars.
