Google in a petition before the Delhi High Court on Thursday alleged that a confidential interim fact-finding report prepared by the Director General of the Competition Commission of India (CCI) in connection with the company’s ongoing investigation into Android smartphone agreements Leaked in the media.
Senior advocate Abhishek Manu Singhvi, representing Google, mentioned the matter before Chief Justice DN Patel and requested an urgent hearing in the matter. The petition, which was listed by the Court Registry for hearing on September 27, was ordered to be listed for hearing on Friday after its mention.
Google has said that the leak of the report is a breach of trust that reduces its defense capability and harms it and its partners. A Google spokesperson said the company was deeply upset that the report was leaked to the media “in the custody of the CCI”.
The spokesperson said, “Protecting confidential information is fundamental to any government investigation and we are pursuing our legal right to seek redress and prevent any further unlawful disclosure. We have fully cooperated and maintained confidence throughout the investigation process and we expect the same level of confidence from those institutions.”
Google also said that the DG’s results do not reflect the final decision of the CCI and that the submission of the investigation report is an interim procedural step. It said, “Google has not yet had a chance to review the results of the DG, let alone presenting its defense of any of the allegations.”
