Delhi HC grants bail to student activists: Delhi High Court has ordered the release of three student activists Natasha Narwal, Devangana Kalita and Asif Iqbal on bail. While ordering the release of these three students on bail, the High Court on Tuesday made very important comments about the government’s thinking about the constitutional right to protest and its impact on democracy. Delhi Police has made these three students accused in the North East Delhi riots case. He has been made an accused under the very strict provisions of the Unlawful Activities Prevention Act (UAPA).
The Bench of Justice Siddharth Mridul and Justice AJ Bhambhani, while releasing the three students on bail, said, “We are compelled to say that it appears that the opposition given in the Constitution in the eyes of the Government, in the uneasiness of suppressing dissent The distinction between authority and terrorist activity is becoming blurred. If this mentality continues to grow like this, it will be sad for democracy.”
Bail granted with these conditions
The Delhi High Court has ordered bail to the three students on submission of personal bonds of Rs 50,000 each and two local sureties. In connection with the Delhi riots, four cases have been filed against Devangana Kalita and three against Natasha Narwal. His lawyer Adit Pujari told that he has got bail in all three cases and now he will be released from jail. The High Court has also directed the lawyers of the three students to provide the copy of the order at the earliest. The court has asked the three accused students to provide their phone numbers to the in-charge of the local police station and inform the police if there is any change in their place of residence. They have also been directed not to approach any witness and not to tamper with the evidence.
The trial court had rejected the bail application
Asif Iqbal Tanha, a student of Jamia Millia Islamia University, challenged the trial court’s order rejecting his bail application in the High Court. The trial court had rejected the bail application of Asif Iqbal, saying that he was accused of playing an active role in the conspiracy of the riots and prima facie the allegations appeared to be true. In the Delhi High Court also, the police had opposed the bail on the basis of these arguments. But the bench did not accept the arguments of the police. Tanha’s lawyer said that during the riots his client was neither present in Delhi nor had he visited any riot-prone place. The lawyer said that there is no evidence to link Tanha with the riots in any way.
